Question: Can you fight a dui for methadone when it is prescribed to you?

I have a friend that just got pulled over for not turning into the "right " lane supposedly and they are giving her a dui for being on methadone, frist they thought she was on speed then they changed their mind and said it must be weed. Neither applied just the methadone and she hasn't taken the blood test, can she fight it? or get it dropped? This happened in Lynnwood Washington.

It doesn't matter what she was on. If she was under the influence and it impaired her driving, it is a DUI (driving under the influence). The bottle of her prescription probably says do not drive or operate machinery while on this medication. It says that for a reason.

Technically if youre taking something, and its impairing your driving, youre guilty of DUI. No other questions asked. You can get a DUI for taking an anti-histamine and having that make you drowsy. However, she should make it clear she wasnt on anything illegal before they add more charges.

You can fight that esp since she wasnt tested they have no proof she was on anything it sounds like they thought she was under something but if it was a prescribe med first see if the meds have a warning like "dont drive or operate heavy machjery " or something if it dont and even if it does take the meds to court and tell thenm what happened tell the truth that you didnt know it affected driving im sure if your honest and never do it again they should let it go besides you will be proving she wasnt on speed or weed which is wrong on the officer they shouldnt assume “Remember, when you assume, you make an ass out of u and me.� oscar wilde

You are responsible for your actions. Getting behind the wheel while under the influence of any drug, prescription or otherwise, is a just crime in that you put extensive assets and lives at risk. You should, if you want a lighter sentence, be open, honest and frank with the judge.

If it impaired her driving it doesn't matter if it was a legal drug or not....... it's still a DUI.

If its prescibed to you, YES you CAN fight it! my friend went threw the SAME thing and they charged her with dui too. cops are rediculous these days! just make sure she gets paperwork from the prescribing doctor to bring to court and the judge should dismiss it right then and there and the cop will feel like a total idiot which is the best part!! hehe!
